The request of Mr.



Peter Gregory Obi, the presidential candidate for the Labour Party, to have the Independent National Electoral Commission, INEC, refrain from changing the configuration of the BVAS technology used to conduct the presidential election on February 25 was denied on Wednesday by the Court of Appeal in Abuja.

According to the Court, granting the request would put the electoral body's ability to conduct the state house of representatives and governorship elections on March 11 in jeopardy.

The Court agreed with INEC that the accreditation data on the BVAS devices had been uploaded to its backup server and could be accessed whenever necessary.

The Appellate Court based its agreement with INEC on the fact that none of the allegations in the Electoral Body's counter-affidavit were refuted.

The court said that granting the request of Obi and the Labour Party would tie the hands of INEC in the conduct of Saturday’s gubernatorial election.

The Court further held that the claims of INEC that information on the BVAS devices cannot be tampered with during uploading were not attacked by Obi and were, as such, deemed authentic.
